Description: This rule makes administrative updates to FRA’s railroad safety appliance standards regulations, including updating addresses that are no longer valid. FRA is changing § 231.0(f), Applicability and Penalties, by replacing references to specific penalty amounts with general references to the minimum civil monetary penalty, ordinary maximum civil monetary penalty, and aggravated maximum civil monetary penalty. FRA is adding language to this section referring readers to 49 CFR part 209, appendix A, where FRA will continue to specify statutorily provided civil penalty amounts updated for inflation. FRA is also amending this section to update the web address from www.fra.dot.gov to https://railroads.dot.gov/. To be consistent with other definitions of “person,” such as 49 CFR 270.5, FRA is updating the reference in the parenthetical from 1 U.S.C. 1 to 49 U.S.C. 21301.
Under § 231.33, Procedure for Special Approval of Existing Industry Safety Appliance Standards, FRA is amending § 231.33(b)(1) to add a requirement that an email address be provided in a petition for special approval. FRA is amending § 231.33(c)(1) to require submission of a petition for special approval via email to FRAWaivers@dot.gov. FRA is also amending § 231.33(c)(2)(iii) to require submission of a statement of interest via email to FRAwaivers@dot.gov. FRA is amending § 231.33(g) to update the web address from www.fra.dot.gov to https://railroads.dot.gov.
